To be held at On The Bricks at 508 E Street in Fairbury, NE.

 

LOCATION: From Fairbury, Nebraska, 3 1/2 miles West on Hwy 136, 1 Mile South to 711 Road, then ¼ Mile West to the Southeast corner of the farm.

 

LEGAL DESCRIPTION: A 74.55 Acre Tract of Land Located in the Southeast Quarter (SE ¼) in Section Thirteen (13), Township Two North, (T2N), Range One East (R1E) of the 6th P.M., Jefferson County, Nebraska.  Complete meets and bounds legal description is available on the survey.

 

GENERAL DESCRIPTION: This is a level to gently rolling tract of non-irrigated cropland.  It has been surveyed and contains 74.55 deeded acres.  The farm contains approximately 53.8 acres of Crete Soils with the balance being Geary. 

 

FSA DESCRIPTION: FSA data shows that there is a total of 73.9 acres of cropland.  The balance is waterways and roads.  DCP Crop Data is as follows:

MINERAL & WATER RIGHTS: Any mineral and water rights owned by the Seller will transfer to the Buyer.

 

INSPECTION:  The ground is open for inspection with respect for the crop.

 

POSSESSION: Full possession will be granted March 1, 2024.

 

TAXES: Seller shall be responsible for the 2023 and all prior years’ taxes.  The 2022 taxes were $3,576.54 (prior to survey).  Buyer will be responsible for all subsequent years’ taxes.

 

MANNER OF SALE: The property will be sold by dollars per acre times 74.55.

 

TERMS: An earnest deposit equal to 50% of the purchase price shall be paid the day of the auction upon signing the purchase agreement.  The earnest deposit shall be made to the Sellers and Heartland Bank.  The balance shall be paid on closing which will be on or about January 3rd, 2024 in the form of certified funds.  Title insurance and escrow closing fees shall be shared equally between Buyer & Seller.  Any lender’s policy or required endorsements shall be the expense of the Buyer.  Nebraska Title Company shall be the title insurance company and will conduct the escrow closing.  The farm is not being sold contingent on loan approval.  Make all financial arrangements prior to the auction.  The property is sold in “AS IS” condition with no survey, warranties, inspections, repairs, or treatments provided or paid for by the Seller or Real Estate Firm.  Schultis & Son, Inc. are agents of and represent the Seller in this transaction.  Any announcements made the day of the auction take precedence over printed or oral information provided.  Sale is subject to confirmation by the Seller.
