TRACT I – 154.98 +/- ACRES - NEBRASKA
LOCATION: From Fairbury, NE North on Hwy 15 1 ½ miles to 715 Rd, then 1 mile East. This is the SW corner of the tract.
LEGAL DESCRIPTION: The Southwest Quarter (SW ¼) Except FR, Section Twenty-Five (25), Township Three North (T3N), Range Two East (R2E) of the 6th Principal Meridian, Jefferson County, Nebraska subject to easements and restrictions whether of record or not.
GENERAL DESCRIPTION: This non-irrigated tract contains approximately 129 acres of gently rolling cropland, almost 22 acres of grass and ponds, and the balance is the bin site and roads. The farm contains approximately 124 acres of Crete Soil with the balance being Hastings and Morrill. The house and building site is another parcel and NOT included in the sale of this tract.

GENERAL DESCRIPTION: This tract contains approximately 89 acres of non-irrigated cropland with the balance being pasture, timber, waterways and roads. There is also a large pond on this tract. The farm contains approximately 63 acres of Crete Soil with the balance being Edalgo and Lancaster-Hedville Soils.

TAXES: Seller shall be responsible for the 2024 and all prior years’ taxes. Buyer will be responsible for all subsequent years’ taxes. The 2023 real estate taxes were $768.47 (the 2024 taxes were not available at the time of printing).
TERMS & INFORMATION FOR ALL TRACTS
MINERAL & WATER RIGHTS: Any mineral and water rights owned by the Seller will transfer to the Buyer.
INSPECTION: The ground is open for inspection with respect to tenant’s crops. Seller and Auction Company are not liable for accidents or loss during inspection.
CLOSING: Closing shall be on or before December 27th, 2024. The escrow closing will be conducted by the law firm Schwab & Lepant at 311 5th Street, Fairbury, NE.
POSSESSION: Possession for all tracts will be March 1, 2025.
MANNER OF SALE: Tracts will be offered individually and will not be offered in any combination.
TERMS: An earnest deposit equal to 20% of the purchase price shall be paid the day of the auction upon signing the purchase agreement. The balance shall be paid on closing in the form of certified funds. Title insurance and escrow closing fees shall be shared equally between Buyer & Seller. Any lender’s policy or required endorsements shall be the expense of the Buyer. Charter Title shall be the title insurance company. The farms are not being sold contingent on loan approval. Make all financial arrangements prior to the auction. The property is sold in “AS IS” condition with no survey, warranties, inspections, repairs, or treatments provided or paid for by the Seller or Real Estate Firm.
